The law is you need the proof of ownership to foreclose(they need the origanal note) if they don't have it they lose, that is the law.
You can't sell a car if you have no title, you can't repossess a car without a lein on the title. What is so hard to understand? If the bank doesn't have the note and the morgage it loses, too bad, it is their fault. That is what the law is, so live with it.

Look at Old Republic for example one of the nations largest title insurers will not even allow those types of properties to be written, wow. The Robo-signing scandal is just flat out crime, resorting to forgery is hard to even stomach.This is no doubt just now coming out that this issue alone is going to prolong the housing crisis for sometime. The REMIC trusts seem to be a total mess and all the missed assignments, this is why the banks and servicers are forging documents.
